Er, why are you saying Toshiba vs Sony stalemate?

Its true that Toshiba own HD-DVD 100% but no one owns BluRay. While they have certainly invested more than others Sony are just one of many companies backing it.

I personally think people should go with BluRay for the simple reason that I dont want the next gen format to be owned by just one company. I cant see why anyone would want HD-DVD to win unless they have share in Toshiba.

Well, it's not us saying stalemate, that's the head of Sony in the US, no doubt perplexed at the willingness of some studios to back one format exclusively over the other. Looks like this one has a way to go yet, and given a distinct lack of dual-format players, none of we mere consumers look likely to be the winners.

HD DVD was developped by the DVD Forum. Sony and friends are part of this forum. Blu ray, on the other hand, is the one that has Sony written all over it. Sony got others to back the technology, to prevent a repeat of the Betamax episode, where they were the lone wolf. Getting friends on board is simply not enough to get market acceptance.
There are rumors that Matsushita is considering making money, as opposed to staying in good terms with Sony.  A move is to be expected.
